28 เมษายน 2559 เวลาประมาณ 18.00 น. บุรินทร์ เข้าร่วมกิจกรรม “ยืนเฉยๆ” กับกลุ่มพลเมืองโต้กลับ บริเวณอนุสาวรีย์ชัยสมรภูมิ เพื่อเรียกร้องทหารปล่อยตัวประชาชน 8 คน ที่ถูกจับไปไว้ที่ค่ายทหาร April 28th 2016 at around 6 pm, Burin was attending the event “Standing Still” with the Resistant Citizen group at Victory Monument, the purpose of the event was to demand the army to release the 8 people who had been arrested and detained in a military camp. Later, Burin, together with 15 other attendants, were arrested and taken to Phayathai Police Station.

Col. Burin Thongprapai, a staff judge advocate, the King's Guard,2ndCavalry Division, and Pol. Lt. โดยอัยการศาลทหารในฐานะโจทก์ในคดีนี้ แถลงต่อศาลด้วยว่า พ.ท.บุรินทร์ ทองประไพ พยานโจทก์ปากสำคัญ ที่นัดไว้มาศาลไม่ได้ เนื่องจากติดราชการเร่งด่วน ศาลจึงอนุญาตให้เลื่อนสืบพยานไปในวันที่ 6 มีนาคม 2558 The military prosecutor, as the plaintiff, stated to the court that Lt. Col. Burin Thongprapai, plaintiff’s witness, was unable to appear at the court due to urgent government duty. Consequently, the court postponed the witness examination to 6 March 2015.
คมชัดลึกออนไลน์ รายงานว่า หลังฐนกรถูกกักตัวในค่ายทหารครบ 7 วัน เจ้าหน้าที่ทหารโดยพ.อ.บุรินทร์ ทองประไพ นายทหารพระธรรมนูญ นำตัวฐนกรมาฝากขังที่ศาลทหาร ซึ่งศาลทหารอนุญาตให้ฝากขังผลัดแรกเป็นเวลา 12 วัน Komchadluek reported after Thanakorn was detained for 7 days at a military camp, Colonel Burin Thongprapai, a judge advocate, brought him to be detained at the military court who granted the first 12-day detention.
ศาลขึ้นบัลลังก์เวลาประมาณ 13.30 น. โจทก์แถลงต่อศาลว่า พันโทบุรินทร์ ทองประไพ ติดธุระเร่งด่วนไม่สามารถมาศาลได้ สอบจำเลยแล้วไม่ค้าน ศาลจึงเลื่อนกระบวนการสืบพยานโจทก์ในครั้งนี้ออกไป เป็นวันที่ 22 มกราคม 2558 Around 1.30 PM, the military prosecutor stated to the Court that Lt. Col. Burin Thongphrapai had urgent business and could not attend the witness examination. The defendant didn’t have any objection so the witness examination was scheduled on 22 January 2015.
