1. การที่ผู้รับจำนองไปขอให้ศาลขายทอดตลาดโดยปลอดจำนองตาม ป.วิ.พ. มาตรา 289 ถือว่าเป็นการบังคับจำนอง ผู้รับจำนองย่อมมีสิทธิได้รับชำระหนี้ก่อนเจ้าหนี้อื่น(ดูฎีกาที่ 2825/2527)
